EEOC REPORTS RECORD HIGH CHARGES FILED
In the EEOC's annual Performance and Accountability Report, released November 15, 2011, the Commission reported a record 99,947 charges of employment discrimination filed in fiscal year 2011 (October 1, 2010 through September 30, 2011). This marks the largest number of charges filed during any fiscal year since the EEOC was created in 1965. The Report also disclosed the payment of over $360 million by employers to employees claiming discrimination for back pay and penalties allowed under the anti-discrimination laws.
As the number of Charges of Discrimination rises, it is critical that employers consult with counsel before making a decision to terminate or discipline employees. Employers are well advised to consult with an employment attorney prior to making a disciplinary decision, rather than waiting to report what steps the employer has already taken.
