1st Annual Groundhog Open

Haller & Colvin Participates in the 1 st Annual Groundhog Open

On February 2, 2012, a team from Haller & Colvin, P.C. consisting of Martin E. Seifert, Charles J. Heiny, John O. Feighner and J. Spencer Feighner placed 2 nd in the 1 st Annual Groundhog Open, presented by the Fort Wayne-Allen County Economic Development Alliance and the Downtown Improvement District. Local businesses, including Haller & Colvin, P.C. were responsible for designing individual holes on a putting course laid out between the Grand Wayne Center, Embassy Theater and the downtown Courtyard by Marriott. All proceeds raised by the Alliance and the Downtown Improvement District will benefit the Downtown Improvement District's plantings and flowerpots in downtown Fort Wayne. Martin E. Seifert Elected to Leadership of Allen County Public Library

On January 26, 2012, Martin E. Seifert was elected as Secretary of the Allen County Public Library. He is beginning his second year of service on the Board of Trustees. One of the largest libraries in Indiana, the Allen County Public Library serves Fort Wayne and all of its surrounding communities in Allen County. The library is a vital part of the Allen County community and an important resource to all of its citizens. Martin is proud to be part of such an important organization and looks forward to serving.

Haller & Colvin attorney, J. Spencer Feighner selected for ISBA's Leadership Development Academy.

INDIANA STATE BAR ASSOCIATION LEADERSHIP DEVELOPMENT ACADEMY

Associate J. Spencer Feighner has been selected to participate in the inaugural Indiana State Bar Association's Leadership Development Academy. The inaugural class consists of 25 members from across the State who have been admitted to practice for less than 15 years. The Academy is a leadership program established to empower and develop lawyers to become involved in significant leadership roles in local and state bar associations and community organizations.

The inaugural class will participate in several sessions held throughout the State in 2012. Each session will focus on different topics, including state and local government, diversity, public safety, and education. For more information, please visit the Indiana State Bar Association.

On December 7, 2011, Sherrill Wm. Colvin was elected as Chair of the Allen County Public Library Foundation. He has served on its Board of Trustees for 6 years. The Allen County Public Library is an incomparable repository and resource for information on Abraham Lincoln and his times. The genealogical collection in the library is considered second only to the Salt Lake City Mormon genealogy collection in the United States.

Lindsey C. Swanson Joins Haller & Colvin, P.C.

Haller & Colvin, P.C. is proud to announce that Lindsey C. Swanson has joined the firm as an associate attorney. Ms. Swanson recently completed a year-long judicial clerkship for the Honorable Nancy Eshcoff Boyer and the Honorable David J. Avery of the Allen County Superior Court, Civil Division.

While in law school, Ms. Swanson completed an externship with the Honorable Mary Katherine Huffman in the Montgomery County Common Pleas Court in Dayton, Ohio. Ms. Swanson also participated in the University of Dayton School of Law Clinic - Juvenile Division, where she was a licensed internwith the State of Ohio and advocated on behalf of juveniles within the court system.

Ms. Swanson is licensed to practice in the State of Indiana and in Federal Court in the Northern and Southern Districts of Indiana. Her areas of practice include Civil Litigation, Personal Injury, Wrongful Death and Civil Rights.

Haller & Colvin Await Decision From the Indiana Tax Court

HALLER & COLVIN AWAIT DECISION FROM THE INDIANA TAX COURT

Mark E. GiaQuinta and Melanie L. Farr are awaiting a decision from the Indiana Tax Court in a matter that could determine an issue of great importance to Assessors around the State. Verizon Data Services (now Frontier) filed a petition for the review of its personal property tax return shortly before the deadline. The decision on their appeal was delayed at Verizon's request. During the subsequent appeal to the Indiana Board of Tax Review, a case was decided that said the local boards must render decisions by October 30th of the year the return is filed. In this case, Verizon's appeal was not decided at the local level until after October 30th but the company only filed the request for review on October 28th, two days before the deadline.

Haller & Colvin, P.C. represents the Allen County Assessor. Mr. GiaQuinta and Ms. Farr contend that the October 30th deadline does not apply to decisions by the Property Tax Board of Appeals when reviewing the decision of the Assessor. If it does, there is little opportunity to call a public meeting in only a few hours when the taxpayer files its review request close to the deadline.

The Tax Court is deciding preliminary matters at this time but may be called upon to clarify the initial decision that led Verizon to argue that the October 30th deadline applies to its case.

Donald C. Swanson, Jr. joins Haller & Colvin, P.C.

Haller & Colvin is proud to announce that Donald C. Swanson, Jr. has joined our firm. Mr. Swanson began practicing law in 1973. He is admitted to the practice in Indiana, Florida and Michigan.

His area of practice has focused primarily in the criminal defense area with an emphasis on white collar crime, drug and controlled substance violations, and driving while intoxicated cases. He has handled these cases both at the trial and appellate levels. He is a certified law enforcement instructor and has served as the Indiana representative to the Federal Court Panel Attorneys in Washington, D.C. He is a member of the Allen County Bar Association, Michigan Bar Association, Florida Bar Association, and is the past chairperson for the Criminal Procedure Committee of the Allen County Bar Association.

Also included in his areas of practice is the representation of individuals before Indiana licensing boards, including the medical, nursing, real estate and legal licensure organizations in Indianapolis. He is admitted to the federal courts in Northern and Southern District of Indiana as well as the 7 th Circuit Court of Appeals and the United States Tax Court. He is a member of the National Association of Criminal Defense Lawyers and the American Trial Lawyers Association. He has served for 18 years on the Allen County Sheriff's Merit Board.

Mentor Match Program

Robert W. Eherenman and Holly A. Brady are among the first Allen County attorneys to participate in the new Indiana State Bar Association Mentoring Program.

MENTOR MATCH  

Haller & Colvin, P.C. is proud to announce that the firm has begun working with the Indiana State Bar Association in its Mentor Match program. The purpose of the program is to bring together an experienced attorney and a recent law school graduate or young attorney for the purpose of discussing core concepts, lawyering skills and ethics. The experience of the Bar Association has been that both participants obtain new knowledge and new practice concepts.

In this first year of the program at Haller & Colvin, P.C., senior attorney Robert W. Eherenman will mentor J. Spencer Feighner, who has been with the firmfor approximately four years, and senior attorney Holly A. Brady will mentor Lindsey C. Swanson, who will be joining the firm at the end of summer. The programs for each of the young attorneys will begin in the next couple of weeks and should require about six months time. Each of the participants will receive certificates of completion at the end of the session.

John O. Feighner named president of the Indiana Trial Lawyers Association

John O. Feighner, of Haller & Colvin, P.C., has been named President of the Indiana Trial Lawyers Association.

The ITLA Board of Directors elected Mr. Feighner to the one-year term on Friday, April 28, 2011.

The Indiana Trial Lawyers Association is dedicated to the constitutional rights of open access and equal protection for all persons in the Indiana Civil Justice System.

ITLA has 1,028 members.

Mr. Feighner is a 1976, cum laude graduate of Indiana University School of Law, Indianapolis; a 1973 graduate of Brown University; and a 1969 graduate of Culver Military Academy.

He was the president of the Culver Legion in 1980.

Mr. Feighner is an experienced civil trial lawyer and has been a certified civil trial advocate by the National Board of Trial Advocacy since September 1997.

He has been a Fellow in the American College of Trial Lawyers since 2000 and served as the state chairman in 2009-2010.

Mr. Feighner also serves as an Attorney Member of the Indiana Judicial Nominating Commission and as an Attorney Member of the Indiana Commission on Judicial Qualifications.

Locally, he is a member of the Benjamin Harrison Chapter of the American Inns of Court and served as president in 1996-1997.

His peers have annually named him one of the Best Lawyers in America since 2001 and he has been named by the Indiana Super Lawyers magazine as one of the top attorneys in the state each year since 2003.

Mr. Feighner is also the Assistant Allen County Attorney, a position he has held since 1977. His role in representing Allen County government includes serving as legal counsel for the Sheriff of Allen County since 1977, and trial counsel for various county agencies in state and federal courts and other governmental legal activities.

Mr. Feighner has served as a member of the ITLA Executive Committee since 2002.

Mark GiaQuinta to take part in school choice panel

Haller & Colvin attorney Mark GiaQuinta will be taking part in a panel discussion on school choice on Tuesday, May 10 at the Allen County Public Library at 5:30 p.m.

The panel discussion is being hosted by the Notre Dame Club of Fort Wayne and will follow a brief lecture.

Mr. GiaQuinta will be joined in the panel discussion by Professor Richard Garnett, the Associate Dean and Professor of Law and Concurrent Professor of Political Science at Notre Dame, and Jonathan Hancock, the Headmaster at Canterbury School, an independent, college preparatory day school for students age 2 through Grade 12 located in southwest Fort Wayne.

The panelists will discuss their views on various aspects of the school choice debate. The event is free and open to the public.

Mr. GiaQuinta, along with his role as an attorney with Haller & Colvin, is president of the Fort Wayne Community Schools Board of Trustees.

A Trial Attorney In Action!

Colvin Sherrill Wm. Colvin, a founding partner of Haller & Colvin, P.C.,  is scheduled to start a jury trial in the Allen Superior Court in Fort Wayne before Judge Levine on May 17, 2011. The case deals with civil damages. Three days are reserved for the trial.

This is an rare opportunity to see one of our premiere trial attorneys in action. For several years Mr. Colvin has been rated one of the best trial lawyers in America. He is a board certified civil trial advocate and a fellow in the American College of Trial Lawyers. He has taught seminars for trial lawyers in several states and has regularly lectured on trial tactics at lawyer educational meetings.

Robert W. Eherenman to testify to Senate Commity on zoning bill

Haller & Colvin attorney Robert W. Eherenman will be testifying in front of the Indiana Senate Local Government Committee on Wednesday, March 9 at 1:30 p.m. on the adoption of House Bill 1311. The bill is a comprehensive amendment to the Indiana zoning statutes and Mr. Eherenman collaborated with Indianapolis attorney John Molitor on the bill's content.

The bill has already passed in the Indiana House of Representatives.

You can watch Mr. Eherenman's testimony live online by visiting the Indiana General Assembly's streaming video page. Mr. Eherenman will be in Conference room 130.

The zoning statutes, Mr. Eherenman said, haven't been updated since 1995.

House Bill 1311, he said, "will bring the statute into line with the law as the courts have interpreted it."

The bill covers several topics including judicial review, plat vacation, board and commission membership, hearing examiners, publication and subdivisions.

Mr. Eherenman is a past Chair of the Land Use and zoning Section of the Indiana State Bar Association and is involved with the Section's legislative and continuing legal education committees. He is a member of Haller & Colvin's business law team and practices in numerous areas of law.

Indiana Super Lawyers magazine has named Haller & Colvin attorneys Sherrill Wm. Colvin and John O. Feighner as 2011 Super Lawyers.

According to the magazine's web site, Super Lawyers magazine names attorneys in each state who received the highest point totals, as chosen by their peers and through the independent research.

Both Mr. Colvin and Mr. Feighner have been on the magazine's Super Lawyer list every year since 2004.
